Declarations of Trust

When two or more people own a property there is a trust. Having the beneficial ownership correctly documented is vital. Commonly the legal owners and the beneficial owners are the same, but they need not be. The legal owners can hold property for others or for a person’s lifetime or other specified periods. We can advise on all these issues and the choice and number of Trustees.

Land Registry applications

Unregistered property must be registered when it is next sold, gifted or mortgaged. A voluntary application can be made to assist establishing boundaries and claim title to land that has been occupied or to register rights (drainage, water supply) that have been used. If issues or potential claims arise we can advise you on protection of your position by entering restrictions, notices or cautions.

Boundary Issues, Easements and Covenants

Establishing the position of or ownership of boundaries is often complicated and the source of potential conflict. We can analyse and advise with site visits if necessary. We can interpret existing easements for rights of way or services and covenants or obligations and their enforceability against present and future owners and draft new Deeds of Easement or Covenants or Corrective Deeds arising from previous ambiguity. This is a complex area and we have the experience to comprehensively deal with these issues.

Landlord and Tenant

We deal with all aspects of Landlord and Tenant from Assured Shorthold Tenancies to long term and protected Leases in their preparation, their interpretation and dealing with extensions of long Leases, difficulties with tenants, serving relevant Notices and seeking possession through Court application if necessary.

Tax Planning and advice

Other than routine sale and purchase of your only home there are potentially significant tax consequences arising in particular from gifts or sales at an under value or purchase of a second or multiple homes, all of which we can analyse in relation to the transaction and advise upon the tax implications and alternative methods of achieving the objective.
